Plain terms for booking, prices, cancelling and what you may do with your photographs. If something here is unclear, ask me before you book.
About these terms
Nickelfall is the photo and video business of Dave Bowatta in Sudbury, Ontario, a division of Auxcura Inc. ("I", "me", "Nickelfall"). These terms apply to this website and to any session or work you book with me. If we agree something different in writing, what we agreed applies instead.
Booking a session
Sending a request through the booking form, the contact form or by email does not book anything, and costs nothing. I reply with times that work. A session is booked when we have agreed the date, place, price and what is included, the deposit is paid, and I have confirmed it by email.
Drone imagery, video and photo packages start from $340. Product, real estate, fashion and editorial work are quoted case by case. A price or quote is only for the work it describes, and the launch offer does not apply to drone packages unless I say so in writing.
Prices and payment
- Listed prices are in Canadian dollars and are on the pricing page.
- The launch offer takes 50% off every listed service until December 31, 2026. After that the regular price applies.
- Sessions are inside Greater Sudbury city limits. Travel outside them is added to the price.
- Listed prices are before HST. 13% HST is added, and I confirm the total with you before a session is booked.
A non-refundable deposit holds your date. I confirm its amount, and how and when the rest is paid, in writing before a session is booked. Prices on this site can change, but a price I have confirmed to you does not.
Cancelling or moving a session
Things happen, and weather matters for outdoor work. If you need to cancel or move a session, tell me as early as you can and I will do my best to find another time. The deposit is non-refundable if you cancel, but where I can I will move it to a new date. I will confirm in writing, before a session is booked, any other charge that applies if a session is cancelled late. If I have to cancel because of weather, illness or something outside my control, we will find a new date or I will refund what you have paid for that session.
Your photographs and how you may use them
I keep the copyright in every photograph and video I make. When your session is paid for, you receive a licence to use the delivered images for personal purposes: to print them, share them with family and friends and post them on your own social media, with credit to Nickelfall where you can.
Using them commercially, such as in advertising, on a business website or for resale, needs a written agreement with me first. Please do not apply filters that change the look of the images or remove my signature or watermark where I have placed one. I will tell you when and how the finished images are delivered when we confirm the session.
My use of the work
I may want to show a photograph from your session on this site, in a portfolio or on social media. I will ask first, and I will not publish photographs of you without your permission. You can withdraw that permission later and I will take them down from the places I control.
Collaborations
A collaboration is a shoot we plan together, for both our portfolios. I am not paid and you are not paid, and neither of us owes the other a fee. Costs on the day, like your travel, wardrobe or a makeup artist you bring, are yours unless we agree otherwise in writing first. An email counts as writing.
The copyright is mine. I keep the copyright in every photograph and video we make, as I do in all my work.
What I may do. You allow me to use the images and video from our collaboration, including your likeness, in my portfolio, on this website and on social media, in advertising and in print, to promote Nickelfall. This holds anywhere in the world and for as long as I run the business, and I pay you nothing for it. I will credit you where I can, and I will not use the work in a way that misleads people about you. If you want a particular frame taken down, tell me and I will remove it from the places I control.
What you may do. You may use the finished images I deliver to show your own work: your portfolio, your personal social media and your modelling or creative profiles, with credit to Nickelfall. You may not sell them, license them, print them for sale, use them in advertising or to promote a business or product, enter them in paid competitions or let anyone else do any of that. Anything commercial needs my written agreement first. Please keep edits light and leave my signature or watermark where I have placed one.
Looking after each other. You confirm you are 18 or over. If you bring someone with you, you have their agreement to be photographed. You can stop at any point in a shoot, and so can I.
Nothing is promised until we agree. Sending a request does not book a shoot, and I choose who I work with. A collaboration goes ahead when we have agreed the idea, the date and the place, in writing.
Your details. I use them to reply, and to keep a record of what you agreed to: your answers, the date you ticked the box and which version of these terms you saw. The privacy policy says how I handle them.
Sessions, people and places
If you book a session for a group or for someone else, you confirm you have their agreement to be photographed. You are responsible for any permission needed at a location you choose, such as a private property or a venue. I may decline or stop a session that is unsafe. I will tell you if a location is unsuitable for the light, the weather or safety.
Liability
I work carefully, but photography still depends on people, light and equipment. If I cannot deliver the images for a reason within my control, my responsibility is limited to refunding what you paid for that session. I am not liable for indirect loss, and nothing here limits any right you have under Ontario consumer law that cannot be excluded.
Using this website
The photographs, text, logo and design on this site belong to me or to Auxcura Inc. and may not be copied, reproduced or used without my written permission, except for sharing a link or a small excerpt with credit. I take care that the site is accurate, but it is provided as it is, and I am not responsible for the content of sites that I link to. How I handle your information is in the privacy policy.
Law and contact
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Any dispute that we cannot settle between us will be heard by the courts of Ontario. I may update these terms, and the version on this page, with its date, is the one that applies to new bookings.
